Terms of Service

1. Acceptance of Terms

PondLog (the “Service”) is operated by Rian Loubser, a sole proprietor trading as “PondLog”, based in Cape Town, South Africa (“we,” “us,” “our”).

By accessing and using the Service, you accept and agree to be bound by these Terms. If you do not agree, please do not use the Service.

Eligibility (18+). The Service is intended only for users aged 18 or older. By using PondLog you confirm you are at least 18. This matches our Privacy Policy, which states we do not knowingly collect data from anyone under 18.

2. Description of Service

PondLog is a web-based application designed for koi keepers and fish dealers to log water parameters, track fish health, manage inventory, and maintain customer records. The Service is provided “as is” and “as available.”

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and are fully responsible for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.

You agree to provide accurate, current, and complete information during signup and to update your information as needed.

4. User Responsibilities

You agree not to use PondLog for any purpose that is unlawful or prohibited by these terms. Specifically, you will not:

  • Use the Service to store or transmit any content that is abusive, offensive, obscene, or otherwise objectionable
  • Attempt to gain unauthorized access to the Service or its systems
  • Disrupt or interfere with the normal operation of the Service
  • Reverse-engineer, decompile, or attempt to discover the source code
  • Use automated tools (bots, scrapers) to access the Service without permission
  • Resell or redistribute access to the Service
  • Use the Service for any illegal purpose

5. Intellectual Property

All content on PondLog, including but not limited to text, graphics, logos, images, and software, is the property of PondLog or its content suppliers and is protected by international copyright laws.

You retain ownership of any data you upload (pond records, readings, fish information, customer records). By using PondLog, you grant us a license to store, display, and process your data to provide the Service.

We do not claim ownership of your data and will not sell or commercialize your personal information.

6. Limitation of Liability

To the fullest extent permitted by law, PondLog and its owners, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

7. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee the accuracy, completeness, or reliability of the Service or any content provided through it. Use of the Service is at your own risk.

Important: PondLog provides information and tools. Any advice or recommendations given through the Service (such as dosage guidance or treatment suggestions) are informational only and not a substitute for professional veterinary or aquaculture advice. You are responsible for verifying any information before acting on it.

8. Data Accuracy & Responsibility

You are responsible for the accuracy and appropriateness of any data you enter into PondLog. We make no warranty regarding the accuracy of calculations, trends, or recommendations generated by the Service based on your data.

Any decisions made based on PondLog data are your responsibility. We recommend consulting with professionals (veterinarians, aquaculture specialists) before making significant decisions affecting your fish or pond.

9. Service Modifications

PondLog reserves the right to modify or discontinue the Service (or any part thereof) at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

We will provide reasonable notice of material changes and do not intend to discontinue the Service without cause.

10. Fees and Payment

Your subscription continues until cancelled. You agree to pay the subscription fee for your selected tier according to the billing cycle chosen (monthly or annual).

Billing occurs automatically on the date your subscription renews. You are responsible for providing accurate payment information and promptly updating it if it changes.

Payments and merchant of record. Payments are processed by Paddle, which acts as the merchant of record (the seller of record) for your purchase. This means your contract for payment is with Paddle, Paddle's Checkout Buyer Terms apply to the transaction, and Paddle collects and remits any applicable VAT, GST, or sales tax. Refunds are processed through Paddle and are also subject to Paddle's terms (see our Refund Policy).

Automatic renewal. Subscriptions renew automatically at the end of each billing period (monthly or annually) at the then-current price, until you cancel. For annual plans we will give you reasonable advance notice before each automatic renewal, consistent with the South African Consumer Protection Act. You can cancel at any time (see Section 11).

Refunds are governed by our Refund Policy.

11. Cancellation

You can cancel your subscription at any time through your account settings (or through Paddle's customer portal). Cancellation takes effect at the end of your current billing period. No refunds are issued for unused portions of a paid period, except as provided in our Refund Policy or as required by law.

Your statutory rights. Nothing in these Terms or our Refund Policy limits rights you have under South African law that cannot be excluded, including any cooling-off right under section 44 of the Electronic Communications and Transactions Act (ECTA) and rights under the Consumer Protection Act (CPA). Where the law gives you greater protection than these Terms, the law prevails.

Upon cancellation, your account moves to the free plan (limited logging). Your data is retained for 12 months and then deleted unless you request deletion sooner.

12. Privacy

Your use of PondLog is also governed by our Privacy Policy. Please review it to understand our practices.

13. Third-Party Services

PondLog uses third-party services including Supabase (database), Paddle (payments), PostHog (analytics), and Cloudflare (security). Your use of PondLog means you acknowledge and agree to the terms of service of these third parties.

14. Indemnification

You agree to defend, indemnify, and hold harmless PondLog, its owners, employees, and agents from any claims, damages, losses, or costs (including legal fees) arising from:

  • Your violation of these Terms
  • Your violation of any law or third-party rights
  • Your use of the Service
  • Any data you input or actions you take using the Service

15. Governing Law

These Terms are governed by and construed in accordance with the laws of South Africa, and you irrevocably submit to the exclusive jurisdiction of the courts of South Africa.

16. Changes to Terms

We may update these Terms at any time. We will notify you of material changes by email or by posting the updated Terms on the Service. Continued use of the Service after such notification constitutes acceptance of the updated Terms.
